Definitions

  • Landlord-Magdalena Drzyba limited partnership, with an office in Krakow on Bashtova str. 1 lokal 1, 31-134 Krakow, TIN: 6762476307, leading website www.wordswords.pl who performs the booking and provides the service, or an intermediary in booking and providing the service.
  • Lessee-a client or clients of the lessor who enters into a contract with the lessor for the temporary use of residential premises (lease agreements for an object for recreation or tourist accommodation).
  • Accompanying persons-the totality of all persons who use the rented premises together with the tenant, are duly notified to the lessor.
  • Object-a room (apartment or room) available for short-term rent by the landlord, reserved for tourist or overnight purposes,
  • Object lease – a short-term lease agreement concluded between the lessor and the lessee under the conditions specified in these Rules, to which the law of June 21, 2001 does not apply.   • Final booking confirmation - a form for accepting the booking fee.
  • Booking fee-a fee of 30% of the cost of the service, which is a prerequisite for the provision of the service.
  • Booking form-an electronic document that is the only form for booking or canceling an apartment rental through Magdalena Drzyba SP. K.
  • Consumer-a natural person who performs a legal action with an entrepreneur that is not directly related to his economic or professional activities
  • Remote agreement-a transaction that does not involve the simultaneous presence of both parties, in which one of the parties is the " consumer”
  • A contract concluded outside the premises of an enterprise is a transaction that is not performed in a place intended for customer service and appropriately designated in accordance with the provisions on entrepreneurial activity, and the customer must be a "consumer" in accordance with the law of May 30, 2014 on consumer rights [ of 2014, paragraph 827 of the late ed. mind.).
  • Regulations-a list of procedures that allow you to make objects available for a fee paid by the tenant. Failure to comply with the rules on the part of the lessee means that the lessor refuses to provide services. 

§ 1 General provisions

  • These terms and conditions define the terms of booking and short-term rental of properties posted on the site www.wordswords.pl both on booking portals and on sale by phone or email. Please read and accept these Terms and Conditions when booking. Booking is also the conclusion of a rental agreement between Magdalena Drzyba SP. K. and the lessee on the terms and conditions specified in these Terms and Conditions.
  • These Terms of Use are an integral part of the property lease agreement concluded between the lessee and Magdalena Drazhba LLC.

§ 2 booking

1. Tenants can book apartments as follows:

  • Through the online booking system that is available on the site wordswords.pl . The booking gets guaranteed booking status after paying at the selected price in the amount of 100% immediately after booking. Failure to make a deposit within 24 hours means cancellation of the reservation.
  • By sending an email to magdalena.drazba@vp.pl send a request via the contact form or by phone. After contacting Magdalena, Drzyba SP. K. prepares an offer together with the cost of the stay and bank details, which must be paid 100%. In order for the reservation to receive guaranteed status, prepayment must be made within 24 hours. no deposit on the specified date means cancellation of the reservation.
  • Through booking portals m.in. booking.com, Airbnb, Expedia. Failure to charge the advance payment means cancellation of the reservation.

2. For additional services not included in the booking, payment is made when ordering additional services, payment can be made in cash or by payment card.

3. The costs of bank transfers are fully borne by the lessee.

4. Payment of all accommodation fees and crediting of the Magdalena Drazhba SP. K account must be made in any case before the rental apartment is placed at the disposal of the tenant.

5.Please read the terms and conditions before booking. Booking means that you agree to the terms and conditions contained in the terms and conditions. If the tenant does not agree with the Terms and Conditions, they must immediately cancel the reservation.

6. At the time of booking, the rental agreement is considered concluded.

7. Payments for credit cards and bank transfers are made via PayU.

8. The offer is submitted by phone, sent by e-mail or posted on the website www.wordswords.pl It is informational in nature and is not a commercial offer within the meaning of Article 66 (1) of the Civil Code.

§ 3 Change or cancellation of a reservation

1. Change of booking by Magdalena Drzyba SP. K is possible only in case of force majeure circumstances that prevent the rental of the room by Magdalena Drzyba SP. K.. The highest force is understood as: natural disasters, seizure of the apartment by a state authority, strikes, wars, riots and deprivation of the apartment by the supplier: electricity, gas, heat energy or water. Then Magdalena Drzyba SP. K. will offer the tenant to stay for another period or terminate the lease agreement and return the advance paid.

2. Magdalena Drzyba SP. K. reserves the right, in case of failure or accidental events in the object, to provide a replacement object with parameters similar to the reserved object. In case of disagreement with the replacement of the object, the contract is terminated, and Magdalena teases sp.k.ma obligation to return the rental fee to the tenant.

§5 payment

1. The renter can pay for the reservation in one of the following ways::

  • Payment for accommodation can be made through the secure online payment system PayU, with which Magdalena Drzyba SP. K. has signed a corresponding agreement. Payments for credit card transactions and electronic transfers are made through the PAYU payment center
  • Direct transfer to the bank account of Magdalena Drzyba SP. K.

§ 6. Prices

1. All prices offered by Magdalena Drzyba SP. K. are expressed in PLN and include the current VAT.

2. The cost of the booked services is calculated in accordance with the price list in force on the date of booking.

3. The fee paid by the tenant does not include: climate fee, additional services ordered, such as: airport transfer, additional change of bed linen and towels, baby cot, pets allowed, cleaning on request of the tenant + additional services available on the website www.zakoznami.pl

4. Utilities (water, gas, electricity, heating) are included in the price.

5. At the tenant's request, Magdalena Drzyba SP. K. can issue an invoice, provided that the tenant provides the details for the invoice at the time of booking. If you do not provide the invoice details at the time of booking, Magdalena Drzyba SP. K. reserves the right to refuse to issue an invoice.

§ 7 tenant's accommodation rules

1. The Lessee must notify Magdalena Drzyba SP. K. of the time of their arrival at least 1 day before the arrival date. Notification can be made by phone or email.

2. Key collection takes place at the place and time specified in the booking confirmation. Arrival must take place at the hours previously confirmed by phone.

3. Hotel nights start at 14: 00 on arrival and end at 11: 00 on the day of departure, unless otherwise agreed.

4. The tenant must strictly observe the set eviction time. A delay in eviction caused by the tenant or accompanying persons will result in a charge equal to the receivable for the next, round-the-clock rental.

5. The method of return of keys is determined by the employee of Magdalena Drozba LLC at check-in.

6. The lessee is obliged to leave the object in an unreal state in relation to the state in which he received it.

7. The lessee undertakes to operate the object for its intended purpose, not to remove any elements of its equipment and decoration from the object, and also undertakes not to copy the keys to the object given to him for the duration of his stay.

8. The Tenant is financially responsible for any damage or damage to items of equipment and technical equipment caused by his fault or by visitors. In this case, Magdalena Drzyba SP. K. reserves the right to charge the tenant an amount equivalent to the loss incurred and charge the tenant a credit card for the damage caused after departure.The tenant is obliged to protect the property every time it is abandoned by closing the windows and entrance door with a key and carefully taking care of the key.

9. The tenant receives 1 set of keys to the property. In case of loss of a set of keys, the tenant will charge an amount of PLN 250.

10. The tenant is obliged to observe the night silence, safety and fire safety regulations. From 22:00 to 07:00, any behavior that interferes with the rest of other residents is prohibited. In the event of a reasonable complaint from other residents of the building or the security services, Magdalena Drzyba SP. K. has the right to terminate the contract with immediate effect (evict the tenant) without the obligation to repay the debt for the remaining booking period.

11. Smoking of candles and incense is prohibited in the hotel. 

12. In case of gross or hooligan violation of the rules set out in these Rules, aggressive behavior of the tenant, violation of order or silence at night, use of narcotic drugs or in a state of alcoholic intoxication, Magdalena Drzyba SP. K. has the right to immediately terminate the contract and remove the tenant together with his accompanying persons with the assistance of the police, while maintaining the right to rights to pay for all booked accommodation by the tenant.

13. It is forbidden to sublet the object and transfer it to third parties. Violation of the ban results in immediate termination of the contract, while the landlord retains the right to receive payment for the entire stay booked by the tenant.

14. Magdalena Drzyba SP. K.does not bear legal and civil liability for claims in the event of accidents, personal injuries or death of the tenant or accompanying persons on the territory of the object during the tenant's stay. Magdalena Dryba is fully exempt from such liability.

15. Magdalena Drzyba SP. K. is not responsible for items left on the property or in public areas.

16. The number of guests staying in the hotel must not exceed the number indicated in the booking. In case of violation of this clause, Magdalena Drazhba has the right to terminate the contract with immediate effect without the obligation to return the outstanding amount for the remaining booking period or to impose a fine of 200 PLN-person.

17. Magdalena Drzyba SP. K. is not responsible for any inconvenience caused during the tenant's stay, related to: construction or finishing works that may be carried out on the territory of the building in which the object is located, as well as around it, interruption for reasons beyond the control of Magdalena Drzyba SP. K., delivery of mass media information (m.in. electricity, water, c. o.), noise emissions from neighboring properties.

18. The property is strictly non-smoking-the tenant will charge 500 PLN for each violation.

19. If you wish to extend your stay, please inform us no later than 14: 00 the day before the booking deadline. The extension of the stay will only be carried out if there are available facilities.

20. In case of an unjustified call to Magdalena Drazhba SP. K employees, an additional fee of PLN 150 per hour plus travel costs will be charged.

§8 Lessee's Liability

1. The lessee is responsible for all damages caused to the lessee or to companions and pets.

2. The lessee is obliged to immediately inform LLC "Magdalena Drozba" about the damage caused or about compensation for damage.

3. If the lessee refuses to accept financial responsibility for the damage, Magdalena Drzyba SP. K.draws up a damage report in the presence of a witness and takes measures to compensate for the damage, including filing a claim.

4. If the lessee evades payment of penalties arising as a result of violation of the provisions specified in these Rules, Magdalena Drazhba SP. K.draws up a damage report in the presence of a witness and takes measures to ensure compliance with the relevant requirements.

§9 Complaints, liability of Words & Swords

1. Tenants have the right to file a complaint in case of violations related to the performance of the lease agreement, within no more than 14 days from the end of the stay.

2. The tenant can submit complaints to the following email address: magdalena.drazba@vp.pl

3. The complaint will be reviewed within 14 days of its receipt. The tenant will be informed about the decision file by email.

§10 final provisions

The law applicable to disputes between a landlord and a tenant is Polish law. The provisions of the Law of the Civil Code of April 23, 1964 [z. U. 1964 No. 16, item 93 of the late ZM.] apply to issues not regulated in these Regulations.

§ 11 processing of personal data

1. The lessor is the administrator of the tenant's personal data.

2. The provision of personal data is voluntary, but their provision makes it possible to conclude a lease agreement.

3. Personal data will be processed for the following purposes::

  • Conclusion and execution of a lease agreement on the terms and conditions described in these Terms and Conditions
  • Exercise of powers and obligations arising from the legislation
  • Possible claims or protection against potential claims

4. Personal data will be processed on the basis of::

  • Your consent (Article 6, paragraph 1). (a) RODO),
  • In connection with the execution of the lease agreement or to take actions at your request prior to the conclusion of the lease agreement,
  • Circumstances that the processing is necessary to fulfill the legal obligations imposed on the administrator (article 6, paragraph 1). b) RODO),
  • Objectives that arise from legitimate interests and are pursued by the administrator (article 6, paragraph 1). F) GDPR), i.e. in order to protect against possible claims based on the legitimate interests of the administrator, where the legitimate interest of the administrator is to protect the administrator from third-party claims.

5. Personal data will be processed on behalf of the administrator by its authorized employees. Your personal data may also be shared with our suppliers, to whom we provide personal data processing services m.in. to IT service providers and legal entities. Such subjects process data on the basis of a corresponding agreement with the administrator and only in accordance with his instructions.

6. Your personal data will not be transferred outside the European Economic Area or to any international organization

7. Your personal data will be stored for 5 years, starting from the date of termination of the contract.

8. You have the right to:

  • Access to your personal information
  • Data correction
  • Deleting data
  • Data processing restrictions
  • Objections to further data processing
  • Moving data
  • Revocation of consent to data processing at any time, without affecting the legality of the processing
  • Submit a complaint to the President of the Office for Personal Data Protection regarding a violation of the right to personal data protection or other rights granted under the GDPR
